These Terms of Service ("Terms") govern your use of the WeScanFilm website and the digitization, transfer, and restoration services we provide from our studio at 12805 Harmon Rd Suite 215, Fort Worth, TX 76177. By using this site or placing an order with us, you agree to these Terms. If you do not agree, please do not use the site.

Who we are

WeScanFilm is a photo, film, and heirloom digitization studio operating in Fort Worth, Texas, serving the Dallas–Fort Worth area. In these Terms, "we", "us", and "our" refer to WeScanFilm; "you" refers to the person using this site or placing an order.

Use of the site

You may use this site to learn about our services, view examples of our work, and contact us. You agree not to use it to transmit unlawful, infringing, or harmful material; not to attempt to gain unauthorized access to our systems or another user's data; not to interfere with the site's operation; and not to scrape, harvest, or systematically extract its content for commercial purposes without our written permission.

The information on this site is provided for general guidance. Turnaround times, formats, resolutions, and prices described on the site are indicative. The terms that govern your specific project are the ones set out in the written quote and work order we agree with you. Where this site and your work order conflict, the work order controls.

Project requests and quotes

Submitting a form on this site starts a conversation; it does not create a contract and does not reserve capacity. A binding order exists once we have inspected your materials, issued a written quote, and you have accepted it. Quotes are based on the item counts, formats, and condition described to us. Because collections are frequently different in person than in description — more items, unexpected formats, damage, mold, brittle splices, or non-standard media — we may revise a quote after inspection, and we will tell you before we do any work that exceeds what you approved.

Your materials: custody, risk, and condition

We take the custody of your originals seriously and handle them with the care that irreplaceable material deserves. You should understand and accept the following before entrusting anything to us.

You warrant that you have the right to submit the materials. You confirm that you own the materials you deliver to us, or that you have permission from the owner and from any copyright holder to have them digitized. You agree to indemnify us against any third-party claim arising from material you asked us to copy.

Aged media is inherently fragile. Film, tape, and paper degrade. Emulsion lifts, tape binder becomes sticky, splices fail, negatives curl, scrapbook adhesives bond to photographs, and magnetic media loses signal. We use appropriate handling techniques to minimize risk, but some material cannot survive handling regardless of care, and some cannot be recovered at all. We will tell you when we see that risk before proceeding.

Limitation on loss of originals. Except where caused by our gross negligence or willful misconduct, and to the fullest extent permitted by Texas law, our liability for loss of or damage to submitted materials is limited to the amount you paid us for the work on those materials. We recognize that this does not represent their sentimental value; no commercial term can. If a collection is genuinely irreplaceable and you want protection beyond this limit, tell us before you deliver it so we can discuss arrangements in writing.

Uncollected materials. We will contact you when your order is ready. If materials remain uncollected for 90 days after we notify you that the work is complete, and we have been unable to reach you at the contact details you provided, we may charge reasonable storage costs.

Digital files and delivery

We deliver your digitized files in the format and on the medium set out in your work order. You are responsible for verifying delivery and for keeping your own backup once files are in your possession. We retain a working copy for a limited period after delivery so that we can replace a lost drive or re-issue a download link, after which our copies are deleted. That retention period is a convenience, not a backup service — please do not rely on it as your only copy.

Payment

Payment terms are set out in your work order. We do not accept card payments through this website; no page on this site collects card details. Payment is arranged directly with the studio and processed through our payment provider's own secure systems.

Intellectual property

Yours stays yours. You retain all rights in the content of the materials you submit and in the digital files we produce from them. Digitizing your photographs gives us no ownership of them, no license to publish them, and no right to use them in our marketing. We will only use an image of your material publicly with your specific, separate permission.

Ours stays ours. The design, text, photographs of our own studio and sample work, logos, and other content of this website are owned by WeScanFilm or our licensors and are protected by copyright and trademark law. You may not copy, republish, or create derivative works from them without our written permission.

Disclaimer of warranties

This website is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, in relation to the site itself. This disclaimer does not limit the standard of care we owe you for the digitization work you order, which is to perform it with the reasonable skill of a professional studio.

Limitation of liability

To the fullest extent permitted by Texas law, WeScanFilm will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of your use of this website or our services, whether the claim is founded in contract, tort, strict liability, or any other theory, and even if we were advised of the possibility. Our total aggregate liability arising out of any order is limited to the amount you paid us for that order. Nothing in these Terms excludes liability that cannot lawfully be excluded.

Indemnification

You agree to indemnify and hold harmless WeScanFilm and its owners, employees, and contractors from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the site, or your submission of materials you did not have the right to have copied.

Governing law and jurisdiction

These Terms and any dispute arising out of them or out of our services are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You and WeScanFilm agree that the exclusive venue for any action shall be the state or federal courts located in Tarrant County, Texas, and you consent to the personal jurisdiction of those courts.

Privacy

Our handling of your personal information — including the custody of your originals, the analytics tools we run, and your right to opt out of them — is described in our Privacy Policy. California residents should read the Your Privacy Choices section, which explains the "Do Not Sell or Share My Personal Information" right and how we honor Global Privacy Control signals. The Privacy Policy is incorporated into these Terms by reference.

Changes to these terms

We may update these Terms from time to time and will revise the "last updated" date above when we do. Continued use of the site after a change constitutes acceptance of the revised Terms. The Terms in force when you placed your order govern that order.

Severability and entire agreement

If any provision of these Terms is held unenforceable, that provision will be limited or severed to the minimum extent necessary and the remaining provisions will stay in full force. These Terms, together with your work order and our Privacy Policy, form the entire agreement between us regarding this website and our services.
